Effective Date: June 4, 2026
1. Acceptance of Terms By submitting an intake application, scheduling a consultation or session, making a payment, or otherwise engaging with Dream Makers Elite Fitness ("DME"), you agree to be bound by these Terms of Service.
2. Services Dream Makers Elite Fitness provides performance training, athletic development, and position-specific coaching services for student-athletes. All sessions are conducted under the direction of Coach Tony Beaty and authorized DME staff. Service availability is subject to capacity constraints and advance registration requirements.
3. Registration & Payment All session registrations require advance payment in full to secure a time block. Payment is processed securely through Stripe. Unverified or unpaid registrations will not be honored.
4. Cancellation & Refund Policy Client-initiated cancellations made more than 48 hours before a scheduled session may be eligible for a credit toward a future session. Cancellations within 48 hours are non-refundable. No-shows forfeit the full session fee.
5. Assumption of Risk & Health Acknowledgment Athletic training involves inherent physical risks. By registering, you acknowledge these risks and represent that the participating athlete is in good physical health or you accept full responsibility for participation.
6. Liability Waiver To the fullest extent permitted by applicable law, Dream Makers Elite Fitness, its owners, coaches, staff, and affiliates shall not be liable for any damages arising from participation in DME programs.
7. Media & Photography Release DME may capture photographs, video footage, or performance data during training sessions for use in marketing materials and social media. You grant DME a non-exclusive, royalty-free license to use such materials unless you opt out in writing prior to your first session.
8. Code of Conduct All athletes, parents, and guardians are expected to conduct themselves with respect and professionalism. DME reserves the right to terminate enrollment without refund for disruptive or disrespectful conduct.
9. SMS Communications Consent By providing your mobile phone number during registration, you consent to receive SMS communications from Dream Makers Elite Fitness related to scheduling, session reminders, program updates, and operational notifications. Reply STOP to opt out. Reply HELP for assistance. Message and data rates may apply.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
10. Intellectual Property All training methodologies, curriculum materials, and branded content associated with Dream Makers Elite Fitness and the #That'sThatBeatyWork system are the exclusive intellectual property of Dream Makers Elite Fitness.
11. Governing Law These Terms shall be governed by the laws of the Commonwealth of Pennsylvania. Disputes shall be resolved in the courts of Delaware County, Pennsylvania.
12. Modifications DME reserves the right to update these Terms at any time. Continued use of our services constitutes acceptance of revised terms.
